What Does Retaliation Mean?

Retaliation is defined as an adverse action taken by an employer against an employee who has been identified as engaging in a protected activity. Protected activities could include raising concerns about conditions or activities in the workplace that have a negative effect on the safety, health, and well-being of the employees or the public.

Retaliation by the employer can also occur when an employee reports an injury or even as a way of discouraging an employee from reporting an injury.

Adverse actions that constitute retaliation can include intimidation, discipline, denial of benefits, and the firing or laying off of the employee who is engaged in the protected activity.

Workplaces are encouraged to establish anti-retaliation programs. Retaliation against an employee is not only harmful to the employee who experienced the adverse action, but it can also have a negative impact on overall employee morale due to its effect on the willingness of other employees to report their concerns.
